Queensland booked hire compliance with JollyDrivers

How JollyDrivers helps Queensland booking entities, operators and drivers meet the Transport Operations (Passenger Transport) Act 1994 and its 2018 Regulation — driver authorisations, booked hire licences, safety management plans, records and BEAR reporting — with the gaps admitted.

The rulebook

Queensland took the old fatigue provision (TOPTA s 91B) out in 2024. Fatigue is now managed through the general safety duties and the safety management plan — some older guidance still cites s 91B, and JollyDrivers doesn't.

Every step of the way

  1. Onboarded. A driver's licence, driver authorisation, police check and medical certificate, and a vehicle's registration, booked hire service licence, certificate of inspection and insurance, each go into a Queensland document type with its expiry date. The operator approves each one.
  2. Booked. Every booking goes through one door and one set of checks, whoever makes it.
  3. Assigned. JollyDrivers works out whether the driver and vehicle are cleared for Queensland work and tells the operator — it warns rather than refuses today.
  4. Driven. Each stage is stamped with a time and a name; incidents and complaints go on the operator's case register.
  5. Paid. The tax invoice is raised in the operator's own Xero.
  6. On the record. The booking's history, the safety plan in force that day, and the drivers' and vehicles' documents stay available to produce.

The booking business

A booking entity needs a booking entity authorisation from TMR. Every responsible duty holder — which includes a booking service provider for the service — must have a safety management plan (TOPTA ss 67Z, 67ZC), developed having regard to the people, vehicles and other relevant matters (Reg s 77G), accessible to those who need it (s 77J), reviewed at least every three years and on the prescribed triggers (s 77K), prepared in consultation with the other duty holders so far as reasonably practicable (s 77L), with superseded plans kept for at least five years (s 276A). TMR can require a safety audit (TOPTA s 67ZE).

Drivers

A booked hire driver needs a driver authorisation from TMR. Queensland also requires every personalised-transport driver to complete anti-discrimination (including sexual harassment) and disability-awareness training, delivered by the booking entity or operator under TMR's Required Driver Training notice. When an operator ends an arrangement with a driver on one of the prescribed grounds, TMR must be told immediately (Reg s 117).

Vehicles

A booked hire vehicle needs a booked hire service licence, registration, and a current certificate of inspection. The vehicle's registered operator must keep it safe and fit for purpose (TOPTA ss 67H, 67R).

Built Each vehicle belongs to its driver and carries its own booked hire service licence, certificate of inspection, registration, CTP and insurance documents with expiry dates, shared with each operator separately, plus a service log.

Partly built A booking names the driver's primary car; it does not yet freeze which vehicle did each trip onto the record.

Safety and fatigue

Queensland sets no maximum driving hours for booked hire drivers since TOPTA s 91B was omitted in 2024. Fatigue is managed through the safety duties (TOPTA ss 67N, 67O) and the safety management plan.

Built Each driver's hours counted from their trips across every operator they drive for on JollyDrivers, empty legs included, against a cap the driver sets, with history reports for the driver and the operator — and never a "breach" label, because the law sets no limit.

Built — switched on by choice The warning when a job would take a driver past their cap, and the hold on confirming that job until somebody acknowledges it.

Incidents and complaints

A death, serious injury or illness, or dangerous incident is a notifiable incident (WHS Act s 35). It must be notified to Workplace Health and Safety Queensland immediately, by the fastest possible means, with a record kept for five years (s 38), and the site preserved (s 39).

Built A case register on the operator's own books for complaints and incidents, with categories, an evidence pack, and — beside every safety-related Queensland case — the notification test, the deadline and the citation. JollyDrivers shows the test; the operator decides.

Records, fares and levies

A booking entity keeps records of its drivers, vehicles and journeys for two years and reports them to TMR through the Booking Entity Activity Reporting portal (BEAR): a quarterly report within 28 days of the quarter's end, and a yearly count of trips (Reg ss 108–110). If the hirer asks, the driver must give an itemised receipt showing the driver authorisation number, the fare and its parts, when the hiring started and ended, and where it began and finished (Reg s 92). Queensland charges no per-trip levy.

Built Every booking kept as a record plus its full event history, with a name on every change. Nothing is purged on a schedule today.

Built Tax invoices in the operator's own Xero, in the operator's name, and no card surcharge anywhere.

Not built yet No BEAR report file — operators still file it by hand from JollyDrivers' records.

Partly built The trip receipt is not sent automatically, prints the booked time rather than the recorded start and finish, and does not print the driver authorisation number.

Privacy

Built Operators see only their own bookings. Driver documents reach an operator only by the driver's recorded consent and are encrypted at rest. Published privacy notices are kept word for word, and privacy requests are tracked against their deadlines.

Not built yet No separate consent step before a driver uploads a medical certificate or police check.

Where JollyDrivers falls short

  • The compliance gate warns the operator; it does not yet refuse the assignment.
  • Expiry, training-renewal and safety-plan review reminders are built and switched off.
  • No BEAR report file, and the trip receipt falls short of s 92 unless completed by hand.
  • No per-trip vehicle snapshot.
  • No live check against TMR's registers — identifiers are checked by people.

JollyDrivers is booking and back-office software. It is not an authorised booking entity, booking service provider or transport operator, and it does not hold anybody's authorisation for them: the operator does, and the operator and driver stay accountable for the duties the law gives them.
